Terms of sale

General Terms and Conditions of Sale (GTC)

General Provisions

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Import Clément (hereinafter referred to as the “Seller”) and any individual or legal entity making a purchase on the Clem-Tex website (hereinafter referred to as the “Customer”).

Any order placed on the website implies unconditional acceptance of these GTC.

Scope of Application

The products offered for sale are described and presented as accurately as possible. The Seller undertakes to supply products that conform to the images and descriptions displayed on the website.

Pricing Terms

Prices are quoted in euros (€), inclusive of all applicable taxes (including VAT), in accordance with the legislation in force.

The Seller reserves the right to change prices at any time. However, the price applied to an order will be the price in effect when payment is finally confirmed. Shipping costs are clearly displayed before the order is confirmed.

Ordering and Payment

An order becomes final once payment has been confirmed. Payment may be made by credit or debit card or by any other secure payment method offered on the website.

The Seller reserves the right to suspend or cancel any order in the event of a previous payment dispute or reasonable suspicion of fraud.

Order Preparation and Delivery

Our parcels are carefully prepared using discreet, suitable packaging.

  • Order preparation time: 1 to 2 business days.

  • Delivery times:

    • Metropolitan France: 3 to 7 business days.

    • European Union: 3 to 15 business days.

In accordance with applicable law, the Seller is responsible for the proper performance of the transport contract. In the event of a lost parcel or a delivery dispute, an investigation will be opened promptly with the carrier to arrange either a replacement shipment or a refund.

Right of Withdrawal and Returns

The Customer has a statutory period of 14 days from receipt of the order to exercise their right of withdrawal without having to provide a reason.

Hygiene Exception (Latex Balloons): In accordance with Article L.221-28 of the French Consumer Code, bags or packaging containing latex balloons that have been opened, unsealed or punctured after delivery cannot be returned or refunded for health protection and hygiene reasons.

Full details of the return procedure are provided in our Returns and Refunds Policy.

Statutory Warranties

All products are covered by the statutory warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the statutory warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

  • Warranty of conformity: The Customer has a period of 2 years from delivery of the goods to take action in the event of a lack of conformity, without having to prove that the defect existed at the time of delivery.

  • In the event of non-conformity or a defective product, the Customer may be entitled to repair, replacement or a refund by contacting our customer service team through our contact form.

Force Majeure

The Seller shall not be held liable for failure or delay in performing its obligations in the event of force majeure, as defined by French case law, including natural disasters, nationwide strikes and disruptions or blockages affecting transport networks.

Intellectual Property

All elements of the Clem-Tex website, including texts, images, logos, trademarks and packaging designs, are and shall remain the exclusive intellectual property of Import Clément. Any reproduction, exploitation or use without prior written authorisation is strictly prohibited.

Personal Data Protection (GDPR)

Personal data collected during the ordering process is necessary for order processing and tracking. In accordance with the General Data Protection Regulation (GDPR), the Customer has the right to access, rectify and request the erasure of their personal data by contacting: contact@clem-tex.com.

Applicable Law and Disputes

These GTC are governed by French law.

In the event of a dispute, the parties shall first seek an amicable resolution. If a complaint remains unresolved by customer service, the Customer is informed that they may refer the matter free of charge to a consumer mediator or use the European Commission's Online Dispute Resolution (ODR) platform.

If no amicable resolution can be reached, the competent French courts shall be those determined in accordance with the applicable jurisdiction rules, including the consumer's place of residence where applicable.

Amendments to the GTC

The Seller reserves the right to amend these GTC at any time. The applicable GTC are those in force on the date the order is placed.
